Welcome to Dinesh Kiran Kashi Laabh (“DKKL”, “we”, “us” or “our”). By accessing our website, making a booking or using our services, you agree to these Terms & Conditions.
Nature of Services
DKKL provides supported stays in Kashi, primarily for senior citizens and their families.
Depending on the package booked, services may include accommodation, suitable meals, assistance with daily activities, accessibility support, local or pilgrimage coordination, family communication and coordination with independent healthcare or travel providers.
The exact services included will be stated in the booking confirmation or service agreement.
DKKL is not a hospital, emergency facility, hospice or medical-treatment provider. Our services do not replace professional medical advice, diagnosis, treatment, nursing care or emergency services.
We do not guarantee any medical improvement, pain relief, spiritual benefit or pilgrimage outcome.
Eligibility and Care Assessment
Bookings must be made by a person who is at least 18 years old and legally capable of entering into an agreement.
DKKL primarily serves seniors who are independent or require mild assistance. Before accepting a booking, we may request information about the guest’s health, mobility, medication, dietary requirements and care needs.
DKKL may decline or discontinue a stay where the guest’s medical, behavioural or care requirements exceed the support that can be provided safely. Guests requiring continuous nursing, advanced dementia care, intensive medical supervision or high-dependency care may be asked to arrange a personal attendant or select a more suitable facility.
We may request a medical fitness certificate or consultation with a qualified healthcare professional before confirming a stay.
Guest and Family Responsibilities
Guests and their authorised family members must:
- Provide complete and accurate health, mobility, medication, allergy and emergency-contact information.
- Inform DKKL immediately of any change in the guest’s health or care requirements.
- Provide prescribed medicines, valid prescriptions and necessary medical supplies.
- Ensure that an authorised family member or emergency contact remains reachable.
- Follow the facility’s safety, hygiene, visitor and conduct rules.
- Treat staff, other guests and service providers respectfully.
- Avoid carrying illegal, dangerous or prohibited items.
DKKL may not be able to provide appropriate assistance if important information is withheld or found to be inaccurate.
Medicines and Healthcare Coordination
Guests remain responsible for obtaining medical advice, prescriptions, medicines and treatment from qualified healthcare professionals.
DKKL may help coordinate appointments, doctors, nurses, physiotherapists, hospitals, ambulances or diagnostic services. Unless expressly stated otherwise, these services are provided by independent third parties and may involve additional charges.
Medication assistance or administration will be provided only where specifically agreed, legally permitted and supported by valid medical instructions.
Medical Emergencies
DKKL is not an emergency medical facility.
In an emergency, DKKL may contact an ambulance, hospital, doctor and the guest’s emergency contact. If the family cannot be reached promptly, the guest or authorised representative permits DKKL to take reasonable steps considered necessary for the guest’s immediate safety.
Ambulance, hospital, consultation, medication, diagnostic and other emergency expenses must be paid by the guest or family.
DKKL cannot guarantee the availability, response time or outcome of any doctor, ambulance, hospital or emergency service.
Bookings and Payments
A booking is confirmed only after the required payment has been received and written confirmation has been issued by DKKL.
Prices, taxes, deposits, payment schedules and services included will be communicated at the time of booking.
Any service not included in the confirmed package—including additional care, medical services, transport, special meals, attendants or extended stays—may be charged separately.
Cancellations and Refunds
Cancellations, rescheduling and refunds will be handled according to the policy shared at the time of booking.
Charges already paid to third-party providers may be non-refundable. Refunds may also be reduced by administrative costs, services already used and expenses incurred for the booking.
No refund will ordinarily be provided for early departure, unused services or a change of personal plans after the stay begins, unless stated otherwise in the booking policy or required by law.
Changes to Services
Pilgrimage visits, local travel and planned activities may be changed, delayed or cancelled because of weather, crowd conditions, festivals, government restrictions, transport disruption, health concerns or safety requirements.
DKKL will make reasonable efforts to provide suitable alternatives where practical but cannot guarantee access to any particular temple, ritual, destination, doctor or service provider.
Third-Party Services
DKKL may coordinate services through travel operators, transport providers, doctors, hospitals, diagnostic centres, therapists and other independent providers.
These providers are responsible for their own services, licences, conduct, availability and professional decisions. DKKL is not responsible for their acts or omissions except where liability cannot legally be excluded.
Guests may be required to accept the separate terms and policies of third-party providers.
Personal Information and Family Communication
DKKL may collect and use personal, identity, contact, payment and health-related information required to assess suitability, provide services, coordinate care, manage emergencies and communicate with authorised family members.
Information may be shared with healthcare professionals, hospitals, emergency services, travel partners or other providers where reasonably necessary for the guest’s care, safety or requested services.
Personal information will be handled according to DKKL’s Privacy Policy and applicable Indian data-protection laws.
Personal Belongings
Guests are responsible for their money, jewellery, documents, medicines, electronic devices and other personal belongings.
DKKL is not responsible for loss or damage unless it results directly from DKKL’s proven negligence. Guests should avoid carrying high-value items during their stay.
Intellectual Property
All website content, photographs, text, branding, training materials, guides and service materials created by DKKL belong to DKKL or its licensors.
They may not be copied, modified, published, distributed or commercially used without prior written permission.
Limitation of Liability
DKKL will take reasonable care while providing its services. However, DKKL does not guarantee medical results, continuous availability of third-party services, uninterrupted website access or any particular spiritual or pilgrimage outcome.
To the extent permitted by law, DKKL will not be responsible for indirect, incidental or consequential losses. Any liability arising from a specific service will ordinarily be limited to the amount paid for that affected service.
Nothing in these Terms excludes liability that cannot legally be excluded, including applicable consumer rights or liability arising from fraud, wilful misconduct or proven gross negligence.
Suspension or Termination
DKKL may suspend or terminate services where:
- Payments remain overdue.
- Material health or care information has been withheld.
- A guest’s needs exceed DKKL’s safe care capacity.
- A guest or visitor threatens the safety or dignity of others.
- Facility rules or these Terms are seriously or repeatedly violated.
- Continuing the service would be unsafe or unlawful.
Where reasonably possible, DKKL will discuss alternative arrangements with the guest or authorised family member.
Events Beyond Our Control
DKKL is not responsible for delays or inability to provide services caused by events beyond its reasonable control, including natural disasters, epidemics, government restrictions, strikes, transport disruption, civil disturbance, utility failure or closure of religious or public places.
Governing Law
These Terms are governed by the laws of India, including applicable consumer-protection, information-technology and data-protection laws.
Subject to any rights available under mandatory consumer law, disputes will fall under the jurisdiction of the competent courts in Varanasi, Uttar Pradesh.
Changes to These Terms
DKKL may update these Terms when its services, policies or legal obligations change. The latest version will be published on the website with the updated date.
